Talks could Lead to Al-Magrahi Coming Back Home, Paper.
Posted on 18. Jan, 2009 by Admin.
Te Scottish newspaper, The Herald reported on Thursday that there has been Official talks going on in secret which could result in Abdelbaset Ali Mohmed al Megrahi dropping his appeal and being freed from Greenock Prison and sent back to Libya under a diplomatic deal.The Herald said that senior civil servants from both the Westminster and Holyrood administrations have met a delegation from Tripoli to discuss how to resolve the impasse over al Megrahi.The paper said an agreement could be reached within months which would see al Megrahi serve the remainder of his 27-year sentence with his family in Libya.Al Megrahi was unjustly convicted in the bombing of the PanAm flight over Lockerbie that occurred in December 1988.Megrahi is suffering from advanced prostate cancer but has been denied bail by judges pending his appeal. The appeal is due to begin on April 27, but could last as long as 12 months because of the complexity of the case and volume of material to be examined.Al Megrahi insists that he wants to clear his name.The Herald said senior civil servants at Whitehall have actively encouraged Libyan officials to apply for prisoner transfer for Megrahi - a move likely to be highly unpopular with campaigners and some of the relatives of the victims of the bombing, who want to hear the fresh evidence in open court.Given the fact that there is a miscarriage of justice in the case, some observers say that this could be a deal that makes British and US authorities avoid the revealing of the process according to which they mislead the Scottish legal system and the public opinion in their countries and the world. We have been encouraged to apply for the prisoner transfer option once the agreement is ratified, but there are concerns as to whether the UK Government can be trusted, a Libyan source quoted by The Herald. The Prisoner Transfer Agreement (PTA) was signed off by a delegation from Tripoli and senior UK officials in November and is due to be ratified by the UK and Libyan parliaments in March.The final decision will ultimately lie with Kenny MacAskill, the Justice Secretary - a point clarified last year during the very public argument which followed the Scottish Professor Robert Black, one of the architects of the original trial at Camp Zeist, said: If this happens it will leave a stain on the Scottish criminal justice system because lots of people now believe there is something wrong with the conviction if he decides he wants to go home and is allowed no other options. But is that really the path a civilised legal system should be taking? Compelling him to go down that path would leave serious questions about the criminal justice system unanswered. {Tripolipost}

Swiss delegation to visit Libya.
Posted on 18. Jan, 2009 by Admin.
A foreign ministry spokesman announced on Friday that the mission would leave on Wednesday and stay in Tripoli until Thursday. He gave no details about the composition of the delegation, except to say that it would not include Foreign Minister Micheline Calmy-Rey.Relations have been strained since July, when one of Moammar Gaddafi’s sons, Hannibal, and Hannibal’s wife were arrested by Geneva police over complaints of mistreatment made by two of their staff while at a hotel in the city.Charges against them were dropped in September after the servants withdrew their complaint, having reached a financial arrangement with Hannibal. But Libya has demanded an apology for the arrest and has taken economic measures against Switzerland, as well as detaining Swiss nationals in Libya.A Swiss legal expert who co-chaired a joint commission investigating the circumstances of the arrest found in December that the Geneva police had used excessive means. However, the Geneva authorities have repeated that they will not apologise, and stressed that that they acted within the law.Switzerland has been making diplomatic efforts to solve the problem from the beginning, but the foreign ministry has given no details.
